Terms and Conditions for CrecheSpots

1. Acceptance of Terms

By accessing or using the CrecheSpots platform (including our website, mobile application, and related services), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Definitions

  • “Platform” refers to the CrecheSpots website, mobile application, and related services
  • “User” refers to any individual or entity using our Platform
  • “Parent/Guardian” refers to users seeking childcare services
  • “Provider” refers to registered childcare facilities and creches
  • “Content” refers to any information, text, graphics, photos, or other materials uploaded to the Platform

3. Account Registration

3.1. To access certain features, you must register for an account and provide accurate, complete information
3.2. You are responsible for maintaining the confidentiality of your account credentials
3.3. You must be at least 18 years old to create an account
3.4. Providers must undergo verification before being listed on the Platform

4. User Responsibilities

4.1. You agree to use the Platform only for lawful purposes
4.2. You will not upload false, misleading, or defamatory content
4.3. You will not engage in any activity that disrupts or interferes with the Platform
4.4. You are responsible for all activities that occur under your account

5. Childcare Services

5.1. CrecheSpots acts as a platform connecting Parents/Guardians with Providers
5.2. We do not employ childcare providers nor are we responsible for the quality of services provided
5.3. Parents/Guardians are responsible for verifying the credentials, qualifications, and suitability of Providers
5.4. All agreements between Parents/Guardians and Providers are solely between those parties

6. Payments and Fees

6.1. Certain services may require payment of fees as specified on the Platform
6.2. All fees are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable
6.3. Payments are processed through secure third-party payment processors
6.4. Refund policies are as specified at the time of transaction

7. Intellectual Property

7.1. All content on the Platform (excluding user-generated content) is owned by CrecheSpots or our licensors
7.2. Users retain ownership of their content but grant CrecheSpots a license to use, display, and distribute such content on the Platform
7.3. The CrecheSpots name, logo, and all related names are trademarks of CrecheSpots

8. User Content

8.1. You are solely responsible for content you upload to the Platform
8.2. You warrant that you have all necessary rights to any content you upload
8.3. We reserve the right to remove any content that violates these Terms or applicable laws

9. Reviews and Ratings

9.1. Users may submit reviews and ratings of Providers
9.2. Reviews must be truthful and based on actual experiences
9.3. Providers may respond to reviews but may not offer incentives for positive reviews
9.4. We reserve the right to remove reviews that violate our guidelines

10. Provider Requirements

10.1. Providers must maintain all necessary licenses, permits, and certifications required by South African law
10.2. Providers must comply with all applicable health, safety, and childcare regulations
10.3. Providers must maintain adequate insurance coverage
10.4. Providers are responsible for the accuracy of their listing information

11. Limitation of Liability

11.1. To the fullest extent permitted by South African law, CrecheSpots shall not be liable for any indirect, incidental, special, or consequential damages
11.2. Our total liability to you for any claims arising from these Terms or use of the Platform is limited to the amount you paid us in the past six months
11.3. We are not liable for the actions or omissions of Providers or other users

12. Indemnification

You agree to indemnify and hold harmless CrecheSpots, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

13. Termination

13.1. We may suspend or terminate your account at our discretion for violation of these Terms
13.2. You may terminate your account at any time by contacting us
13.3. Certain provisions will survive termination of these Terms

14. Dispute Resolution

14.1. Any disputes arising from these Terms will first be attempted to be resolved through good faith negotiation
14.2. If negotiation fails, disputes will be referred to mediation in accordance with the rules of the Arbitration Foundation of Southern Africa
14.3. The parties consent to the jurisdiction of the South African courts

15. Amendments

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

16. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, government actions, natural disasters, or telecommunications failures.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CrecheSpots regarding use of the Platform.
